Terms of Service
Terms governing access to and use of Kaivor.
Effective 4 September 20261. Agreement
These Terms govern the Kaivor Discord bot, documentation website, private beta, support, integrations, and future paid services.
By inviting, configuring, or using Kaivor, accepting beta access, or purchasing access, you agree to these Terms and the Privacy Policy. If you act for a server, company, school, or organization, you confirm that you have authority to bind it. If you disagree, do not use Kaivor and remove it from your server.
2. Operator and contact
Kaivor is a privately operated service based in Norway.
For support, legal notices, abuse reports, or account questions, join Kaivor's official Discord support server and open a private ticket. Do not post confidential or personal information publicly.
3. Eligibility and authority
You must meet Discord's minimum-age requirement for your country and have legal capacity to accept these Terms. You may install or configure Kaivor only where you have permission. Administrators are responsible for appropriate bot permissions and command access.
4. Private beta
Kaivor is currently an invitation-only private beta for testing and evaluation. Features may be incomplete, changed, reset, unavailable, or removed. Beta data may be migrated or deleted when systems change.
Beta access does not promise a commercial launch, continued access, retained features, future pricing, uptime, or support levels. Kaivor may request feedback and use non-confidential feedback to improve the service.
5. Future paid access
Some access or features may later require payment. Before charging, Kaivor will disclose the price, currency, billing period, included features, taxes, renewal terms, cancellation method, and refund terms.
Using the private beta alone never creates a recurring payment. A paid plan begins only after the purchaser accepts the checkout terms and completes the purchase.
Mandatory consumer rights remain unaffected. Specific order, checkout, or written customer terms form part of these Terms and control for that purchase if they directly conflict.
6. Limited right to use
Kaivor grants authorized users a limited, personal, non-exclusive, non-transferable, revocable right to use the hosted service in approved Discord servers during the authorized period. Users receive service access, not ownership of Kaivor's source code, infrastructure, branding, documentation, or systems.
7. Acceptable use
You must not use Kaivor to:
- Violate law, Discord rules, third-party rights, or applicable server rules.
- Harass, threaten, exploit, deceive, discriminate against, or endanger anyone.
- Distribute malware, phishing, spam, illegal content, non-consensual intimate content, child sexual abuse material, or violent extremist content.
- Compromise accounts, collect credentials or tokens, evade enforcement, bypass safety controls, or gain unauthorized access.
- Artificially inflate server membership, engagement, activity, votes, reactions, subscriptions, or platform metrics.
- Scrape, profile, sell, broker, or use Discord API data for advertising, eligibility decisions, surveillance, or unrelated purposes.
- Use message content obtained through Kaivor to train an artificial-intelligence or machine-learning model.
- Abuse rate limits, overload the service, probe for vulnerabilities without written permission, or disrupt Kaivor or other users.
- Copy, resell, sublicense, redistribute, mirror, reverse engineer, or share access with an unauthorized person or server, except where law prohibits the restriction.
- Misrepresent affiliation with Kaivor or Discord.
Report suspected abuse, compromised credentials, or vulnerabilities through a private support ticket.
8. Administrator responsibilities
Administrators control Kaivor's server configuration. They are responsible for:
- Authority and an appropriate legal basis for moderation, logging, transcript, deleted-message, presence, role, and integration features.
- Required notices to members.
- Necessary Discord permissions and safe role hierarchy.
- Restricting sensitive commands, transcripts, logs, exports, and integrations to trusted staff.
- Reviewing automated actions and important outputs.
- Server rules, moderation decisions, procedures, and appropriate backups.
- Removing stored content and disabling unneeded features.
- Responding to questions about their own use of Kaivor.
Kaivor assists administrators but does not replace human judgment. The server owner remains responsible for server decisions and actions performed through the bot.
9. User content and data
You keep your rights in submitted content. You grant Kaivor a limited, worldwide, non-exclusive license to receive, host, reproduce, transform, transmit, and display it only as needed to operate, secure, and support the requested service.
You confirm that you have the rights and permissions needed to submit content and configure its processing. Do not submit sensitive data, passwords, user tokens, payment-card details, or unlawful content. Personal data is handled under the Privacy Policy.
10. Third-party services
Kaivor depends on Discord and may connect to hosting, database, analytics, music, social, weather, translation, and future payment services. Third-party services have their own terms and may change or become unavailable.
Kaivor is not responsible for a third party's independent content, suspension, outage, or policy decision. This does not limit responsibility that law does not permit Kaivor to exclude.
11. Changes and availability
Kaivor may modify, limit, suspend, or remove features to improve the service, protect users, comply with law or platform rules, address risks, or respond to third-party changes.
Unless a written paid plan states otherwise, Kaivor does not promise uninterrupted availability, error-free operation, data preservation, response times, or a service-level commitment.
12. Suspension and termination
Kaivor may restrict, suspend, or terminate access for a breach, abuse, fraud, nonpayment, chargeback, unauthorized sharing, security or legal risk, provider request, or service discontinuation.
Notice and an opportunity to correct may be provided where appropriate. Immediate action may be taken for serious abuse, security threats, legal duties, or platform enforcement.
You may stop using Kaivor by removing it and disconnecting integrations. Removal may not immediately erase stored data. The Privacy Policy explains deletion requests. Provisions intended to survive termination remain effective.
13. Intellectual property and feedback
Kaivor's software, design, branding, documentation, and materials are protected by law. Discord names and marks belong to Discord Inc. Kaivor is not affiliated with Discord Inc.
You permit Kaivor to use non-confidential feedback without restriction or payment. Kaivor will not publicly identify you as its source without permission.
14. Disclaimers
During beta, Kaivor is provided on an "as available" basis. To the maximum extent permitted by law, Kaivor gives no implied guarantee of uninterrupted operation, fitness for a particular purpose, merchantability, non-infringement, moderation outcomes, or preservation of data.
Kaivor may make mistakes, miss harmful activity, or take an unintended automated action. Users must review permissions, configuration, and important outcomes. Mandatory warranties and remedies remain unaffected.
15. Liability
To the maximum extent permitted by law, Kaivor is not liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, revenue, goodwill, opportunities, or data.
For paid access, Kaivor's total liability is limited to the amount paid for the affected service during the 12 months before the claim. For free beta access, total liability is limited to NOK 500.
These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, mandatory data-protection duties, or liability that cannot legally be limited.
16. Commercial customer responsibility
To the extent permitted by law, an organization or commercial customer must reimburse Kaivor for reasonable losses and costs caused by its unlawful content, deliberate misuse, or material breach. This does not apply to an individual consumer where prohibited by mandatory law.
17. Law and disputes
Norwegian law governs these Terms without removing mandatory rights in your country.
The parties should first try to resolve disputes through the official support server. Norwegian courts have jurisdiction. Consumers may use any court or dispute-resolution body available under mandatory consumer law.
18. Changes to these Terms
Kaivor may update these Terms for legal, security, platform, operational, or service changes. The current version and effective date will appear here. Material changes will be announced before taking effect where reasonably possible. Fresh consent will be requested where required.
19. Entire agreement
These Terms, the Privacy Policy, and applicable purchase or written customer terms form the agreement concerning Kaivor. If one provision is unenforceable, the rest remain effective. Failure to enforce a provision is not a waiver.
